Terms and Conditions
In case of problems or questions, personal support is offered to Paying Users via the email address: support@forwardsai.com
1. General information about the App
By “the App”, we refer to the apps named “Andelsboliger i København”, “Apartments Berlin & Copenhagen”, and “Mietwohnungen in Berlin”.
The App provides users with an overview of available apartments in Copenhagen and Berlin.
The apartment listings in the App are generated through crawling and indexing of external websites. A key part of our service is therefore an apartment search engine that collects listings from other websites into one place. We gather information about found apartments and redirect the User (see section 2.4) to the website where the apartment is originally listed.
We continuously monitor the market for apartments in Copenhagen and Berlin to deliver an updated overview of available listings. Paying Users (see section 2.5) gain access to view more detailed information through links to the seller. The advantage of the App is that Users save time by not having to constantly search across the internet for new apartments.
As we are primarily a search engine, the quality of the listings in the App depends on the listings we index from other websites. The App is therefore not responsible for errors or omissions made by the original housing providers.
Please note that errors may occur in the apartment search engine. If you experience issues with our search engine or with the App in general, please contact us at support@forwardsai.com.
To access the main features of the App, you must be a Paying User. As a Paying User, you subscribe to a plan that renews automatically. The subscription can be canceled up to 24 hours before the end of the current period. Users are informed about the subscription and price whenever accessing features reserved for Paying Users. Information about the subscription and pricing will also appear in the invoice email upon subscription activation.
2. General
2.1
These terms (“Terms”) apply to the use of the App (“the Service”). The Terms apply to all use of the Service and constitute an agreement between Forwards AI (Vitus Group, Skolegade 7B, 1. tv., 8000 Aarhus C, CVR: 37099465) and the individual User. A “User” is defined as a person who creates an account on the Service. A “Paying User” is defined as a User who has purchased a subscription that provides access to the main features of the App (see sections 2.4 and 2.5).
2.2
The Service is primarily a fully automated apartment search engine that collects available apartments through crawling and indexing from publicly accessible external websites. The listings displayed in the Service include limited information such as price, size, monthly rent, etc., and Paying Users can click a link to be redirected to the original external website. The amount of information available depends on the source and quality of data from the listing website. Our goal is to collect as many apartments as possible to provide a comprehensive overview of the apartment market in Copenhagen and Berlin. Sources include real estate agents, housing companies, property associations (public listings), selected apartment listings from other housing portals, and apartments posted on social media. We only include listings where the user can directly contact the housing provider (possibly after creating an account). We do not include listings that require a payment to reveal the provider’s contact information.
2.3
Functionality for apartment seekers: The Service includes multiple features for apartment seekers, including: A) The Service acts as a search engine that gives users an overview of available apartments on the market. If the user wants to know more, they are redirected to the external website. B) The Service also acts as an apartment alert agent, allowing Users to create alerts that notify them about new listings that match user-defined criteria such as area, number of rooms, price, and rent. C) The Service directly notifies the User when a new apartment matching the alert criteria becomes available. It is emphasized that the Service only redirects Users to the external websites where apartments are offered, but is never involved in, participates in, facilitates, mediates, or brokers any agreements made between the User and the housing provider.
2.4
As a User of the Service, you can compare and save listed apartments in Copenhagen and Berlin. Users can use the search engine to find relevant apartments on the App. Users may create a limited number of apartment alerts. To create an unlimited number of alerts and to be redirected to the external website where the apartment is listed (by clicking “contact seller”), you must be a Paying User (see section 2.5).
2.5
To enjoy the main features of the App, you must be a Paying User. The main features include the ability to create unlimited apartment alerts and the option to be redirected to the external website (by clicking “contact seller”) where the apartment is listed.
3. Registration
3.1
A User accepts the Terms by creating a User profile on the Service.
3.2
The User may withdraw all consents at any time by deactivating their profile (deleting the account). This can be done by sending an email to support@forwardsai.com. Deleting your profile does not cancel your subscription — cancellation must be done via the App Store or iCloud (see section 7.11).
3.3
As a User, you may be asked to review our Service after successfully finding an apartment. This is entirely voluntary and no incentives are provided for leaving a review.
3.4
For terms related to subscription creation, see section 7.
4. Changes to Terms
4.1
The User is responsible for staying updated on the applicable Terms of the Service and accepts that the Service may change the Terms without notice. The Service will inform Users of any material changes, visible upon login. If the changes concern matters requiring consent, Users will be prompted for renewed consent the next time they log in.
5. For apartment seekers
5.1
Users acknowledge that the apartment database cannot be 100% up to date and that minor errors in listings may occur. Causes may include temporary removals or delays in updates on external websites where apartments are listed.
5.2
It is the User’s full responsibility to ensure that the housing provider has the right to rent or sell the apartment and that all information is correct before any payment is made.
5.3
The User receives the housing provider’s contact information directly, via a link to the external website. The Service only provides the link and is not responsible for whether or when the provider responds to inquiries.
6. Disclaimer of Liability
6.1
The Service is primarily a fully automated apartment search engine that collects available listings from external websites. The Service is not responsible for whether the redirection leads to any agreement between the User and the housing provider. It is emphasized that the Service only redirects users but is never involved in, participates in, facilitates, mediates, or brokers any agreements made between Users and housing providers.
6.2
The Service is not responsible for the accuracy of information retrieved from real estate companies or other third-party websites. The User accepts that the total liability of the App shall under no circumstances exceed DKK 0 (zero).
6.3
The Service is only available as an app offered in the App Store. It is not available as a browser version or on Google Play. If the App is notified of missing or incorrect presentation of listings, it will attempt to correct the issue if possible.
6.4
The App is not responsible for any damages related to downloading, installation, and/or use of the App, or any inability to do so.
6.5
The limitation of liability does not apply in cases of intentional or gross negligence by the App’s operator or management.
6.6
Updates, maintenance, repairs, or feature changes may occur without prior notice. User access may be temporarily or permanently suspended. The App is not obligated to expand specific functionality.
6.7
Compatibility with all hardware and software is not guaranteed. We are not responsible for damage, viruses, or code affecting the User’s device, data, or property as a result of downloading, installing, or using the App.
7. Personal Data Policy
7.1
See our privacy policy for information about how we handle your personal data when using the Service.
8. Purchase Terms, Subscription Conditions, Payment, and Right of Withdrawal
8.1
All purchases are made in the App, and all prices include VAT. Payment is made using the payment method linked to the User’s Apple account.
8.2
Users may access certain features for free (see section 2.4). Users can choose to upgrade to a Paying User subscription to access the main features (see section 2.5). Section 7.11 describes how to cancel the subscription.
8.3
How to purchase a Paying User subscription: Create or log in to your account, tap “Profile” in the lower right corner, and select “Buy subscription.” Confirm your purchase to allow automatic renewal at the start of each billing cycle. Once confirmed, the subscription is active and you gain access to the main features (see section 2.5).
8.4
Current subscription prices: You receive a 7-day free trial with no commitment. After that, the price is DKK 129 per month (for new users). The amount is automatically charged at the start of each new billing period until canceled. Subscriptions can be adjusted during promotional periods. Prices for existing Users will not change without notice.
8.5
Offers and trial periods are available only to non-paying Users. Notifications about trial periods are sent via app notifications and require that notifications are enabled.
8.6
If payment for a renewal fails, the Service will retry for a period to prevent unintended termination. If payment fails for two consecutive billing cycles, the Paying User automatically reverts to a free User.
8.7
Upon purchase, a legal purchase confirmation is sent via email.
8.8
If the User’s payment method expires or is blocked, the subscription will end at the end of the current billing period.
8.9
Receipts can be found in the App Store or iPhone settings.
8.10
Right of withdrawal: The statutory 14-day right of withdrawal applies when purchasing a Paying User subscription. However, Users accept that the right of withdrawal is waived once subscription benefits are used — e.g., accessing apartment details or contacting a seller via the App. To exercise the right of withdrawal, send an email directly to Apple. Refunds are handled only by Apple Support.
8.11
How to cancel the subscription: 1. Open “Settings” on your iPhone. 2. Tap your name. 3. Tap “Subscriptions.” 4. Tap the App name. 5. Tap “Cancel Subscription.” Once canceled, no further charges will occur, and access will end when the current period expires.
9. User Conduct and Misuse
9.1
Misuse of the Service or breach of the Terms constitutes material breach and entitles the Service to terminate the User’s account. In severe cases, Users may be permanently banned.
9.2
If a User’s actions cause data loss or damage to the Service or other Users, the User is liable for direct losses under Danish law. Users are not liable for indirect losses. Data loss is considered a direct loss.
9.3
Users may not decompile or attempt to access the source code or documentation of the Service beyond normal use.
9.4
Users may not sell, transfer, distribute, license, rent, or lend access to the Service to anyone else.
9.5
The Service grants no intellectual property rights to Users. No content may be copied, reproduced, published, uploaded, sent, or distributed without prior written consent.
10. Governing Law and Venue
10.1
Danish law governs these Terms and any agreement between the Service and the User.
10.2
Any dispute arising from the relationship between the Service and the User shall be settled by the Aarhus City Court in the first instance unless otherwise resolved amicably.
